This website is operated under the commercial name AniWays by the professional identified in Section 1 below.

Throughout this website, the terms “AniWays”, “we”, “us” and “our” refer to the operator of the AniWays online store.

These Terms and Conditions govern access to the website, the use of its services and all purchases made through the online store. By placing an order, the customer confirms that they have read and accepted these Terms and Conditions, as well as the policies referred to herein.

These Terms do not exclude or limit any mandatory rights granted to consumers under Portuguese or European Union law.

The customer may use these contact details to request information, submit complaints, report problems with an order or exercise their consumer rights.


2. Scope and Consumer Status

These Terms apply to purchases made through the AniWays online store.

For the purposes of these Terms, a “consumer” is a natural person who purchases products for purposes outside their commercial, industrial, professional or business activity.

Certain consumer protection provisions, including the right of withdrawal and the statutory guarantee regime, may not apply to purchases made by companies, professionals or individuals acting for business purposes.

Customers under the age of 18 may only place an order with the authorization and supervision of their parent or legal representative.


3. Use of the Website

The customer may not use the website:

  • For illegal or unauthorized purposes;

  • To interfere with the website’s security or operation;

  • To introduce viruses, malicious code or harmful technology;

  • To obtain unauthorized access to accounts, systems or information;

  • To reproduce or commercially exploit website content without authorization.

AniWays may restrict or suspend access where there are legitimate indications of fraud, abuse, unlawful activity or a serious breach of these Terms.


4. Product Information

AniWays seeks to present accurate and complete information regarding the products sold through the website.

Each product page should indicate, where applicable:

  • Product name and manufacturer;

  • Main characteristics;

  • Scale, dimensions or specifications;

  • Product availability status;

  • Estimated dispatch or delivery period;

  • Price, taxes and applicable charges;

  • Pre-order conditions;

  • Compatibility or digital functionality, where relevant.

Product images are intended to represent the item as accurately as reasonably possible. Differences caused by screen settings, lighting, photography or minor production variations may occur.

Minor factory paint variations, mould lines, packaging variations or other normal manufacturing tolerances will be assessed on a case-by-case basis. This provision does not exclude the customer’s statutory rights where the product does not conform to the contract.

For collectible products, the retail packaging may be relevant to the value of the product. Significant packaging damage should be reported to AniWays immediately after delivery.

Where a product contains randomized items, such as trading card booster packs, AniWays does not guarantee the inclusion of any specific card, rarity or character unless expressly stated on the product page.


5. Product Availability

Products may be presented under the following availability categories:

5.1 In Stock

The product is physically available at AniWays.

In-stock products are normally dispatched within a maximum of four business days, unless a different period is indicated on the product page or during checkout.

5.2 Available from Supplier

The product is expected to be available from an AniWays supplier or distributor.

These products are normally obtained and dispatched within a maximum estimated period of 20 business days, unless a different estimate is displayed on the product page.

Availability from a supplier is subject to confirmation and may change before AniWays receives the product.

5.3 Pre-Order

A pre-order concerns a product that has not yet been released or received by AniWays.

The release or arrival date displayed on the product page is an estimate based on information provided by the manufacturer, supplier or distributor and may be changed by those entities.

Unless otherwise indicated, pre-orders are normally dispatched within 3 business days after AniWays receives the products from its supplier or distributor.

A manufacturer’s official release date does not necessarily correspond to the date on which AniWays receives the product.

5.4 Mixed Orders

Orders containing products with different availability dates will normally be dispatched once all products are available.

The customer may request a partial shipment. Additional shipping costs may apply and will be communicated before the separate shipment is arranged.


6. Prices, Taxes and Promotions

All prices are displayed in euros and include VAT at the legally applicable rate, unless expressly stated otherwise.

The total amount payable, including shipping and any other applicable charges, will be displayed before the customer confirms the order.

When the exact shipping cost cannot be calculated before checkout, the customer will be informed that additional charges may apply before becoming bound by the purchase.

Promotions, sales or price reductions will be subject to the conditions, products, duration and reference prices displayed in the relevant campaign.

AniWays may change product prices for future purchases at any time. Price changes do not affect orders already validly confirmed.

Manifest Pricing Errors

If a product is displayed with a manifest and objectively recognizable pricing error, AniWays may contact the customer before dispatch to explain the error.

The customer will be given the option to:

  • Confirm the order at the correct price; or

  • Cancel the affected product and receive a full refund of the amount paid for it.

AniWays will not replace the ordered product with a different product without the customer’s express consent.


7. Payment Methods

The payment methods accepted by AniWays are displayed during checkout and may include:

  • Credit or debit card;

  • MB WAY;

  • PayPal;

  • Bank transfer;

  • WooPayments or Stripe;

  • Other methods expressly displayed at checkout.

Only the payment methods actually available during checkout may be used.

Payment information is processed by the relevant payment service provider. AniWays does not normally receive or store the customer’s complete card details.

Where payment is made by bank transfer, the order may remain pending until the funds are received and identified.

AniWays may suspend or cancel an order where there are reasonable and documented indications of fraud, unauthorized payment or unlawful activity. Any amounts received for an order that is not accepted will be refunded.


8. Order Placement and Contract Confirmation

Before submitting the order, the customer must verify:

  • The selected products and quantities;

  • Billing and delivery information;

  • Shipping method;

  • Payment method;

  • Total price;

  • Applicable delivery estimate;

  • Any pre-order or supplier availability conditions.

After the order is submitted, the customer will receive an electronic acknowledgment or confirmation.

The purchase contract is considered concluded when AniWays accepts the order and sends the corresponding confirmation to the customer, subject to successful payment where applicable.

The contractual information will be sent to the customer by email or another durable medium within the legally applicable period and no later than the delivery of the products.

The customer should retain the order confirmation, invoice and applicable Terms and Conditions.


9. Pre-Orders and Deposits

A pre-order may require either:

  • Full payment at the time of the order; or

  • A deposit, normally corresponding to 30% of the product price, with the remaining balance becoming payable before dispatch.

The applicable payment arrangement will be clearly displayed before the pre-order is confirmed.

Where only a deposit is paid, AniWays will contact the customer when the remaining balance becomes due. The customer must complete payment within the deadline communicated by AniWays.

If payment is not received, AniWays may provide an additional reasonable deadline. If payment is still not made, AniWays may cancel the pre-order.

Pre-orders may generally be cancelled before dispatch by contacting AniWays.

Amounts paid will be refunded through the original payment method, subject to the applicable law and any specific lawful conditions clearly disclosed and accepted before purchase.

AniWays will not impose a penalty for the exercise of a statutory consumer right.

A deposit will not be automatically forfeited merely because the customer requests cancellation. Any amount that may lawfully be retained must correspond to a valid legal basis and must have been clearly communicated before the order.

If a pre-order suffers a significant delay, AniWays will inform the customer and provide an updated estimate whenever possible. The customer may accept the new estimate or request cancellation and reimbursement of the amounts paid.

When the estimated delivery period exceeds 30 days, the customer’s purchase of the clearly identified pre-order constitutes agreement to the longer estimated delivery period displayed before checkout.


10. Shipping and Delivery

AniWays ships orders from Portugal using the transport services displayed during checkout, which may include:

  • CTT;

  • DHL;

  • UPS;

  • FedEx;

  • InPost;

  • Other available transport providers.

The available destinations, shipping methods, restrictions, costs and estimated transport times are displayed on the Shipping and Delivery page and during checkout.

Any geographical or product-related delivery restrictions will be communicated at the beginning of the ordering process or before the customer confirms the order.

Unless a different delivery period has been agreed with the customer, the order will be fulfilled within the legally applicable maximum period.

Pre-orders and products clearly identified as “Available from Supplier” may be subject to a longer period expressly agreed with the customer before purchase.

Delivery times are estimates and may be affected by:

  • Weekends or public holidays;

  • High-volume sales periods;

  • Customs procedures;

  • Weather conditions;

  • Transport disruption;

  • Manufacturer or supplier delays;

  • Other circumstances that AniWays could not reasonably prevent.

These circumstances do not exclude the customer’s mandatory rights in the event of failure to deliver within the agreed period.


11. Delivery Address, Failed Delivery and Collection

The customer is responsible for providing a correct and complete delivery address.

The customer should verify the name, street, door number, postal code, city, country, telephone number and any other information required for delivery.

Where a parcel is returned because of:

  • An incorrect or incomplete address;

  • Failure to collect the parcel;

  • Repeated unsuccessful delivery attempts attributable to the customer;

  • An unjustified refusal to receive the parcel;

AniWays may contact the customer to arrange a new shipment.

The reasonable direct cost of a new shipment may be charged to the customer, except where the failed delivery is attributable to AniWays or the carrier selected by AniWays.


12. Transfer of Risk and Transport Incidents

The risk of loss or damage passes to the customer when the customer, or a third party indicated by the customer other than the carrier, acquires physical possession of the products.

A carrier’s electronic status showing “delivered” may be considered evidence of delivery but does not automatically remove the customer’s right to report a missing, incorrectly delivered or damaged parcel.

The customer should report visible transport damage, missing items or delivery discrepancies to AniWays as soon as reasonably possible and should provide photographs of:

  • The external shipping box;

  • The shipping label;

  • Internal packaging;

  • The damaged product or missing contents.

Failure to report the issue immediately does not automatically remove any statutory rights, although prompt reporting may be necessary to allow AniWays to investigate the incident with the carrier.


13. Failure to Supply or Product Unavailability

If AniWays becomes unable to supply an ordered product, the customer will be informed as soon as reasonably possible.

The customer may choose, where available:

  • To wait for a new estimated delivery date;

  • To select an alternative product, only with express consent;

  • To cancel the unavailable product and receive a refund.

AniWays will not automatically replace a product with another item without the customer’s express consent.

Any refund due because of definitive unavailability will be processed without undue delay and within the legally applicable period.


14. Right of Withdrawal

Consumers who enter into a distance contract normally have the right to withdraw from the purchase without providing a reason.

The withdrawal period is 14 consecutive days from the date on which the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the product.

Where several products from the same order are delivered separately, the period starts when the final product is received.

To exercise the right of withdrawal, the consumer must send an unequivocal statement to:

The statement should preferably include:

  • Customer’s full name;

  • Order number;

  • Product or products concerned;

  • Date of receipt;

  • Clear statement that the customer wishes to withdraw from the contract.

The consumer may use the model withdrawal form included at the end of these Terms, but its use is not mandatory.


15. Return of Products Following Withdrawal

After communicating the decision to withdraw, the consumer must return the products without undue delay and no later than 14 days after that communication.

Returns must be sent to:

Unless AniWays agrees to pay them, the direct costs of returning the products are borne by the consumer.

The consumer should use an appropriate, trackable and adequately protected shipping method. The consumer should retain proof of dispatch.

The products should be returned with all included components, accessories, instructions and packaging, where reasonably possible.

The absence of external shipping packaging does not automatically remove the right of withdrawal. However, damage, missing components or excessive handling may cause a reduction in the value of the returned product.


16. Inspection and Depreciation of Returned Products

The consumer may inspect the product to determine its nature, characteristics and operation in a manner similar to what would reasonably be permitted in a physical shop.

The consumer may be responsible for any depreciation resulting from handling that exceeds what is necessary for that inspection.

For collectible products, the following actions may cause significant depreciation:

  • Damaging or discarding collectible packaging;

  • Breaking manufacturer seals where this is unnecessary to inspect the product;

  • Assembling, displaying or using the product beyond what is necessary;

  • Removing protective films or accessories unnecessarily;

  • Opening randomized trading card products or other sealed products whose commercial value is substantially destroyed after opening;

  • Returning incomplete, damaged or altered products.

Opening a product does not automatically remove the right of withdrawal unless a statutory exception applies. However, AniWays may make a proportionate deduction where the consumer’s handling has objectively reduced the value of the product.


17. Refunds Following Withdrawal

AniWays will refund the payments received from the consumer, including the cost of the least expensive standard delivery method offered for the original order.

Additional costs resulting from the customer choosing a more expensive delivery method are not refundable beyond the cost of the standard delivery option.

The refund will be issued through the same payment method used for the original transaction, unless another method is expressly agreed and does not cause additional costs to the consumer.

AniWays may withhold the refund until:

  • The returned products are received; or

  • The consumer provides evidence that the products have been sent back;

whichever occurs first.

The refund will be processed within 14 days from the date on which AniWays is informed of the withdrawal, subject to the lawful right to retain the refund until receipt of the products or proof of return.


18. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in the situations expressly provided by law, including, where relevant:

  • Products made according to the consumer’s specifications;

  • Clearly personalized products;

  • Products liable to deteriorate or expire rapidly;

  • Sealed products unsuitable for return for health protection or hygiene reasons after being unsealed;

  • Sealed audio or video recordings or sealed computer software after the seal has been broken;

  • Digital content not supplied on a physical medium where performance has begun with the consumer’s prior express consent and acknowledgment of the loss of the right of withdrawal;

  • Other exceptions legally applicable to the specific contract.

A standard pre-order is not, merely because it is a pre-order, automatically excluded from the right of withdrawal.

AniWays will identify any applicable exception before the customer becomes bound by the purchase.


19. Order Cancellation

The customer may request cancellation before dispatch by contacting AniWays.

If the order has not yet been dispatched, AniWays will attempt to cancel it and refund the amount paid.

If the order has already been handed to the carrier, it may no longer be possible to stop the shipment. The customer may refuse delivery where appropriate or exercise the right of withdrawal after receiving the product.

No administrative or payment-processing penalty will be charged for the lawful exercise of the right of withdrawal.

This section does not affect the specific pre-order provisions set out in Section 9.


20. Statutory Guarantee and Lack of Conformity

Products sold by AniWays to consumers benefit from the statutory guarantee of conformity applicable under Portuguese law.

For new movable goods, AniWays is responsible for a lack of conformity that becomes apparent within three years from delivery, without prejudice to any different regime legally applicable to a particular product.

A product may lack conformity where, for example, it:

  • Does not correspond to the description;

  • Does not have the promised characteristics;

  • Is unsuitable for its normal or agreed purpose;

  • Is incomplete;

  • Is supplied with the wrong components;

  • Presents a defect that is not compatible with the product’s normal characteristics.

In the event of a lack of conformity, the consumer may have the right, subject to the applicable statutory conditions, to:

  • Repair;

  • Replacement;

  • A proportional reduction in price;

  • Termination of the contract.

Where the lack of conformity becomes apparent during the first 30 days after delivery, the consumer may have the statutory right to request immediate replacement or termination of the contract, under the conditions established by law.

The statutory guarantee does not cover damage caused exclusively by:

  • Accident or impact after delivery;

  • Improper storage;

  • Incorrect assembly by the customer;

  • Modification of the product;

  • Use contrary to the manufacturer’s instructions;

  • Normal wear that is compatible with the product’s nature and use.

These exclusions do not apply where the damage results from an existing lack of conformity, defective instructions or another matter attributable to the seller, producer or manufacturer.


21. Reporting a Defective, Incorrect or Damaged Product

The customer should contact AniWays through customer@anixways.com and provide:

  • Order number;

  • Description of the problem;

  • Photographs or video;

  • Photograph of the product packaging;

  • Photograph of the shipping box and shipping label, where relevant;

  • Any other information reasonably necessary to assess the complaint.

AniWays may request that the product be returned for inspection.

Where a lack of conformity is confirmed, the legally required remedy will be provided without charge to the consumer, including necessary shipping or transport costs.


22. Invoicing

AniWays issues the applicable tax document or invoice in accordance with Portuguese law.

The invoice may be provided electronically using the billing information supplied by the customer.

The customer is responsible for verifying the billing information before completing the order.

After the invoice has been issued, changes to the name or tax identification number may only be possible where legally permitted.


23. Complaints and Customer Support

AniWays will seek to assess and respond to complaints within a reasonable period, taking into account the nature and complexity of the matter.

The use of AniWays’ customer support does not prevent the consumer from accessing the Electronic Complaints Book, an alternative dispute resolution entity or the competent courts.


24. Alternative Dispute Resolution

In the event of a consumer dispute, the consumer may contact an appropriate Alternative Dispute Resolution entity.

For disputes within its territorial competence, including Abrantes, the consumer may contact:

This information does not constitute a declaration that AniWays has voluntarily obtained full membership of a specific arbitration centre unless that membership is expressly stated.

Where consumer arbitration is mandatory under the applicable law, AniWays will comply with the legally applicable procedure.


25. Electronic Complaints Book

Consumers may submit a complaint through the Portuguese Electronic Complaints Book.

The customer may contact AniWays before or after submitting a complaint so that the matter may be assessed directly.

Access to the Electronic Complaints Book does not limit any other consumer right.


26. Personal Data

Personal data is processed in accordance with the General Data Protection Regulation, applicable Portuguese legislation and the AniWays Privacy Policy.

Personal data may be processed, where legally justified, for purposes including:

  • Processing orders;

  • Payment and invoicing;

  • Delivery;

  • Customer support;

  • Fraud prevention;

  • Compliance with legal obligations;

  • Marketing communications where the appropriate legal basis exists.

27. Cookies

The website may use strictly necessary, functional, analytical or advertising cookies.

Non-essential cookies will be used in accordance with the customer’s consent choices and the applicable law.

Further information is available in the AniWays Cookie Policy, where users may also find information about changing or withdrawing their preferences.


28. Third-Party Services

AniWays may use third-party service providers for:

  • Payment processing;

  • Hosting;

  • Website security;

  • Delivery and logistics;

  • Email communications;

  • Analytics;

  • Customer support.

The use of third-party providers does not exclude AniWays’ responsibility where the law makes AniWays responsible for the performance of the contract.

External websites and services are governed by their own terms and privacy policies. AniWays is not responsible for independent content or services that are not controlled by AniWays, except where otherwise required by law.


29. Customer Accounts

The customer is responsible for:

  • Providing accurate information;

  • Keeping login credentials confidential;

  • Preventing unauthorized access to their account;

  • Informing AniWays of suspected unauthorized use.

AniWays may suspend an account where there are legitimate indications of fraud, unauthorized access or serious misuse.

The customer may request the deletion of their account, subject to the retention of data that AniWays is legally required to maintain.


30. Feedback, Reviews and Submitted Content

Customers may submit reviews, comments or other content, provided that the content:

  • Is truthful;

  • Is not unlawful or abusive;

  • Does not infringe intellectual property or privacy rights;

  • Does not contain malicious code;

  • Does not impersonate another person.

AniWays may moderate or remove unlawful, fraudulent, offensive or irrelevant content.

Customer content will not be used in advertising or marketing in a manner that identifies the customer without an appropriate legal basis or authorization.


31. Intellectual Property

The website’s design, text, graphics, illustrations, branding and original content are owned by or licensed to AniWays and are protected by applicable intellectual property laws.

Product names, characters, logos and trademarks belonging to manufacturers or third parties remain the property of their respective owners.

Website content may not be reproduced, sold, modified or commercially exploited without prior authorization, except where permitted by law.


32. Security and Availability of the Website

AniWays takes reasonable technical and organizational measures to protect the website and customer information.

However, internet services cannot be guaranteed to be continuously available or completely free from technical errors.

AniWays may temporarily suspend website access for maintenance, security or technical reasons.

A website interruption does not affect orders already concluded or the customer’s existing statutory rights.


33. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including mandatory consumer rights and liability arising from fraud, wilful misconduct or other situations where exclusion is prohibited.

To the extent permitted by law, AniWays is not responsible for indirect losses that were not reasonably foreseeable when the contract was concluded.

AniWays is not responsible for losses caused exclusively by:

  • The customer’s unlawful or improper use of the website;

  • Incorrect information supplied by the customer;

  • Unauthorized access caused by the customer’s failure to protect account credentials;

  • Events that AniWays could not reasonably prevent.

These provisions do not exclude AniWays’ responsibility for the products, delivery providers selected by AniWays or the correct performance of the purchase contract where such responsibility is imposed by law.


34. Force Majeure

AniWays will not be considered responsible for a delay caused by an event outside its reasonable control, such as natural disasters, serious transport disruption, war, civil disturbance, public authority restrictions, widespread communications failures or similar exceptional circumstances.

AniWays will inform affected customers whenever reasonably possible and will take reasonable measures to reduce the effects of the event.

This provision does not remove any right the consumer may have where the contract can no longer be performed or where the delay becomes excessive.


35. Governing Law and Jurisdiction

These Terms and the contracts concluded through the website are governed by Portuguese law.

Where the customer is a consumer resident in another European Union Member State, this choice of law does not deprive the consumer of any mandatory protection granted by the law of their habitual residence.

Any dispute may be submitted to the competent courts determined under the applicable procedural and consumer protection rules.

Nothing in this section prevents the consumer from using an applicable Alternative Dispute Resolution entity.


36. Changes to These Terms

AniWays may amend these Terms to reflect changes to:

  • Applicable law;

  • Website operation;

  • Payment or delivery methods;

  • Business procedures;

  • Products or services.

Changes apply prospectively from the date they are published.

The Terms applicable to an order are normally those that were in force when the order was confirmed.

Changes will not retroactively remove or reduce rights already acquired by the customer.


37. Severability

If any provision of these Terms is considered invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent legally possible.

The invalid provision will be interpreted or replaced in a manner that most closely reflects its lawful commercial purpose without reducing mandatory consumer rights.


38. Language

These Terms may be made available in Portuguese and English.

Where both versions are available and an inconsistency arises, the Portuguese version will prevail, without prejudice to any mandatory rights granted to the consumer by applicable law.
